Defining A Sexual Assault: Sexual Assault In Houston Premises Liability Claims

Under the Texas penal code, a sexual assault is when a person “…intentionally or knowingly causes the penetration of the anus or sexual organ of another person by any means, without that person’s consent; causes the penetration of the mouth of another person by the sexual organ of the actor, without that person’s consent; or causes the sexual organ of another person, without that person’s consent, to contact or penetrate the mouth, anus, or sexual organ of another person, including the actor….” In sum, under the Texas criminal law definition of sexual assault, the legal term “sexual assault” is synonymous with rape. However, Texas laws do not include the term “rape”, and instead uses the term “sexual assault” to essentially describe the forcible and unwanted sexual penetration or intercourse.
